Qualcomm this week complained that Apple’s attempts to stall the iPhone sales ban in China should be ignored. And it wants China to enforce the ban immediately, pointing out, too, that it should apply to the firm’s newest models.

“Despite Apple’s efforts to downplay the significance of the order and its claims of various ways it will address the infringement, Apple apparently continues to flout the legal system by violating the injunctions,” Qualcomm general counsel Don Rosenberg told Reuters.

Qualcomm, as you may recall, won a ban on iPhone sales in China thanks to Apple violating two of its patents related to touch-based image resizing and app management. Apple has tried to stall this ban, explaining that the ban applies only to iOS 11-based iPhones. And not to its latest iPhones.

But Rosenberg says none of that is true. It very much does apply to these iPhones, he says. And the ban in China should be enforced immediately.

“Apple’s statements following the issuance of the preliminary injunction have been deliberate attempts to obfuscate and misdirect,” he added.

Rosenberg is right: Reuters obtained a copy of the actual ban order and it does not exclude iPhones running iOS 12 or the newest iPhone models. So those reports were both spurious and guided by Apple.

“[Apple] are legally obligated to immediately cease sales, offers for sale and importation of the devices identified in the orders and to prove compliance in court,” Rosenberg said last week. That’s still true.
